TERMS AND CONDITIONS – EL DIVÁN

These Terms and Conditions govern the use of the website and purchases made through El Diván’s online store, including blinds, curtains, awnings, and furniture.

1. Use of the site and services

By using this website, you confirm that you are of legal age or have authorization from a legal guardian. El Diván reserves the right to refuse or cancel service to anyone, at any time and for any reason.

2. Information and content accuracy

El Diván strives to keep all site information accurate and up to date; however, typographical, technical, or human errors may occur. We reserve the right to correct, modify, or update information without prior notice.

Images are for illustrative purposes and may show slight variations due to production processes, materials, and screen settings.

3. Prices and payment methods

  • All prices are in Mexican pesos (MXN) and include VAT.

  • We accept credit card, debit card, and PayPal payments.

  • Prices are subject to change without notice.

  • All orders are subject to validation and availability.

  • In the event of an obvious pricing error, El Diván may cancel the order and refund the amount paid.

4. Customized products and special orders

Most furniture offered in the online store consists of standard models with fixed dimensions.

Any changes to:

  • Dimensions

  • Colors

  • Materials

  • Finishes

must be requested exclusively through the Special Orders section.

Products made under special order:

  • Require a 70% deposit.

  • May be canceled only before manufacturing begins.

  • Are non-cancelable and non-refundable once manufacturing has started.

The remaining balance is due upon delivery.

5. Furniture

5.1 Standard furniture

  • Sold in fixed dimensions as specified on the product page.

  • Delivered fully assembled.

  • Returns are not accepted.

  • Furniture delivery is available only in Cuernavaca, Morelos.

5.2 Special orders

  • Include any customer-requested variation.

  • Are subject to specific quotes, timelines, and conditions.

  • Do not allow returns or exchanges once manufacturing has begun.

6. Furniture delivery

  • All furniture is delivered exclusively in Cuernavaca, Morelos.

  • Delivery includes carrying items upstairs when required.

  • No additional handling fees apply.

  • Store pickup is available only if expressly requested by the customer.

Estimated delivery times are listed on each product page. In case of delays due to operational or supplier issues, the customer will be notified.

7. Installation (blinds, curtains, and awnings only)

  • Installation applies only to blinds, curtains, and awnings.

  • Furniture does not include installation, as it is delivered fully assembled.

  • Installation is available only in Cuernavaca, Mexico City, and metropolitan areas, with a fee of MXN $200 per unit.

8. Cancellations

  • Orders may be canceled before manufacturing begins.

  • Once manufacturing has started, cancellations are not accepted.

  • No refunds apply to manufactured or delivered products.

9. Warranties

Furniture includes a 1-year warranty against manufacturing defects.

The warranty does not cover:

  • Moisture damage

  • Prolonged sun exposure

  • Impact or misuse

  • Commercial use

  • Customer-made modifications

  • Normal wear and tear

10. Product use and liability

El Diván is not responsible for damages resulting from:

  • Improper use

  • Commercial use when the product is not designed for it

  • Unauthorized outdoor use

  • Excessive weight

  • Installation or handling by third parties

11. Limitation of liability

El Diván’s liability is limited to the amount actually paid for the product. Under no circumstances shall El Diván be liable for indirect, incidental, or consequential damages.

12. Intellectual property

All site content is owned by El Diván or used with authorization. Full or partial reproduction without prior written consent is prohibited.

13. Personal data

Personal data processing is governed by our Privacy Policy.

14. Modifications

El Diván reserves the right to modify these Terms and Conditions at any time. The current version is the one published on the website.
